Rules for using our facility, website, and app.

Terms of Service

Welcome to Athlos. These Terms of Service (“Terms”) govern your use of the Athlos facility, website, member portal, and iOS application (collectively, the “Services”) operated by Athlos LLC (“we,” “us”).

By creating an account, booking a session, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to create an account. Parents and legal guardians may register and manage accounts on behalf of minor children. By registering on behalf of a minor, you represent that you have the legal authority to do so and to bind that minor to these Terms (including the liability waiver).

2. Account responsibilities

  • Provide accurate, current, and complete information during registration
  • Keep your password and account credentials secure
  • Notify us promptly of any unauthorized access
  • You are responsible for all activity that occurs under your account

3. Memberships

We offer Silver and Gold tier memberships, billed monthly via Stripe. By subscribing, you authorize recurring monthly charges to your payment method until you cancel.

  • Cancellation: you may cancel at any time from your member portal. Cancellation takes effect at the end of your current billing period — you retain access until then.
  • No partial refunds: we do not refund partial months upon cancellation.
  • Failed payments: if a payment fails, we may suspend your access to membership benefits until the issue is resolved.
  • Price changes:we may change membership pricing with at least 30 days' email notice before the change takes effect.

4. Bookings, cancellations, and refunds

  • Lessons: paid up front via Stripe. Cancellations made at least 5 days before the scheduled time are eligible for a full refund. Cancellations within the 5-day window are non-refundable except at our discretion.
  • Cage rentals: Gold members receive free cage access (subject to a one-per-day limit). Non-members may not currently rent cages.
  • Team practices: a coach who books a team practice is responsible for payment whether or not all team members attend.
  • No-shows: we do not refund no-shows.
  • Facility closures: if we cancel a booked session due to a closure (weather, maintenance, etc.), you will receive a full refund or the option to reschedule.

5. Liability waiver

Use of the facility requires a signed liability waiver (delivered via Documenso). You acknowledge that baseball, softball, fitness training, and related activities carry inherent risks of injury. By signing the waiver and using our facility, you accept those risks and agree to the terms of the waiver, which is incorporated into these Terms by reference.

6. Code of conduct

While using our facility and Services, you agree to:

  • Treat staff, instructors, and other guests with respect
  • Follow all posted facility rules and instructor directions
  • Use equipment safely and report damaged equipment to staff
  • Refrain from harassment, threats, or unsafe conduct of any kind
  • Refrain from filming or photographing other guests without consent

We reserve the right to suspend or terminate the account of any user who violates this code of conduct, with or without refund depending on severity.

7. Acceptable use of the website and app

You may not:

  • Reverse-engineer, decompile, or attempt to extract source code from our app
  • Use the Services to send spam or transmit malicious software
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Scrape, automate, or otherwise extract data from the Services in bulk
  • Use the Services in violation of any applicable law

8. Intellectual property

All content on our website, app, and member portal — including the Athlos name, logo, photos, videos, written content, and design — is owned by Athlos LLC or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.

9. Account termination

You may terminate your account at any time by following the steps on our Data Deletion page. We may suspend or terminate accounts that violate these Terms, our code of conduct, or applicable law. Upon termination, your access to the Services ends immediately; provisions that by their nature should survive termination (intellectual property, limitation of liability, governing law) survive.

10. Disclaimers

The Services are provided “as is” and “as available.” We make no warranty that the Services will be uninterrupted, error-free, or free of harmful components. We are not responsible for any third-party content or services accessed through the Services (including but not limited to Stripe, Apple, Google, Facebook, Documenso, and Supabase).

11. Limitation of liability

To the maximum extent permitted by applicable law, Athlos LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for personal injury caused by gross negligence or intentional misconduct).

12. Indemnification

You agree to indemnify and hold harmless Athlos LLC from any claims, damages, or expenses (including reasonable attorney's fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of the rights of any third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Greene County, Ohio, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page and, for material changes, notify you by email or via a notice in the member portal at least 14 days before the change takes effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

15. Text Messaging (SMS) Program

When you opt in to the Athlos Text Club — for example, through our Text Club sign-up form — you agree to these mobile messaging terms. The program lets us send you booking confirmations, reminders, account notifications, and (if you opt in) occasional offers.

  • How you opt in: you provide your mobile number and check the consent box on our Text Club form. Consent is not a condition of any purchase.
  • Message frequency: message frequency varies based on your bookings and our offers.
  • Cost: message and data rates may apply, depending on your mobile carrier and plan.
  • Opt out: reply STOP at any time to unsubscribe. You will receive one confirmation message and then no further texts.
  • Help: reply HELP for assistance, or contact us at the details below.

We will never sell or share your mobile phone number or text-messaging opt-in information with third parties or affiliates for their marketing purposes. See our Privacy Policy for details. Supported carriers include AT&T, T-Mobile, Verizon Wireless, and others. Carriers are not liable for delayed or undelivered messages. Mobile messaging is provided on an as-available basis.
